Change in F-1 Visa Rules: No More ‘Intent to Leave’ Requirement

The U.S. is considering changes to its F-1 student visa policy, which may benefit Indian students seeking to study there. Currently, international students must prove their intent to return to their home country after completing their studies, often by demonstrating ties like property or family in their home country. However, the proposed DIGNITY Act of 2025 could change this by allowing dual intent for F-1 visa holders.

Students who wish to stay in the U.S. after graduation will still need to qualify for an employment-based or other applicable visas.
The bill also clarifies that STEM PhD graduates can apply for an O visa for individuals with extraordinary abilities in high-demand fields like science, engineering, mathematics, and healthcare.
Additional proposals include taxing OPT students and offering a fast-track green card option for a $50,000 fee (approx. INR 41,50,000).
